For years, Chinese companies could only make low-strength steel, because they didn't have the technology, and the ITC tries to check Chinese imports at the border, not in their production lines. But Baosteel's exports and the products of other Chinese companies have been soaring despite the investigation, rising from a 1.8 million metric tonne annual average in 2013 to a 3.6 million metric tonne average in 2016.
But US Steel is barred from using the ITC to challenge foreign subsidies by a federal law meant to prevent protectionist trade practices. A judge in the Northern District of Illinois ruled that statute unconstitutional in September.
In 2015, the ITC sided with US Steel after a two-year battle against Australia’s largest aluminum producer, Alcoa. The ITC ruled that Alcoa could not claim subsidies because it is not a “domestic producer” - even though it’s headquartered in Pittsburgh and the majority of its production occurs in Australia. The ITC later ordered a $250 million subsidy refund.
It took the US government years to bring any cases against foreign offenders. But that changed starting in 2011, when the Justice Department and the US attorney in Seattle, Jenny Durkan, charged Chinese military officers with an array of cybercrimes related to the steel hacks and others. More than a dozen other countries - including Russia, Taiwan, and Israel - have been charged for similar crimes.
That may be changing. The Justice Department indicted three Chinese men in April for allegedly hacking into US Steel’s network. A federal grand jury in Virginia is considering charges against five others on charges related to the US Steel hacks. The FBI has assisted in those cases, too.
While it’s not clear how much the Chinese companies and Legion are thought to have stolen, the complaint lays out how the US companies believed they were deprived of a competitive edge.
